No laws can prosecute you. Look on Halomaps. There are many Yoyorast Island mods. Did they get in trouble with the law? Even if you take it without permission, and use it, and release it, you can't be prosecuted by the law, because it's all Microsoft's property. Microsoft will protect you :)

Copyright laws are civil, not criminal. You can not be arrested for copyright violations but you can be sued.

You won't be sued. There are no copyrights on maps.
Also, even if there was, you couldn't violate it by creating a mod, because you aren't copying the object. Definition of copy:

There are different approaches to the issue of what is a "copy" of a copyright-protected work. A three-dimensional counterpart of a two-dimensional drawing is usually not a “copy” of the drawing, under United States copyright law. The copyright law of England is different, a copyright in a drawing is infringed by manufacture of the depicted object. As the House of Lords held in British Leyland Motor Corp. v. If you live in the United States, as long as you don't make an exact replica, you won't be copying the map. You'll merely be adding onto it, much like the example: 3D of a 2D drawing.

And:

Copyright law covers the creative or artistic expression of an idea.

Adding thousands of nukes to a map does not infringe on the idea. This is something pretty different than what the creator of Yoyorast Island envisioned. Therefore, you could argue that you are not infringing the copyright.

Of course, since everything belongs to Microsoft once it runs through tool, anyone who wants to complain about you taking "their" stuff would have to complain to Microsoft. Even though Yoyorast Island technically belongs to Microsoft.

Also, search Yoyorast on Halomaps. How many mods have there been? Have they all gotten into trouble? Furthermore, you yourself already made and released a map:

In essence Microsoft/Bungie hold the copyrights to all things Halo regardless of who actually created them. The maps included.
That was the original concept, but there have been changes in the law over the years that have amended that model.

When it comes to fan creations, like a Halo Map or Halo anything, the rule of thumb is that if you do not sell it, it does not hurt or devalue the image of the copyright holder's original work or cause confusion in the market then the copyright holder will most likely not pursue civil action, however he still has the right to if he, for any reason, decides.

Well its not an exact copy because I would be adding ai to the map and that is true yoyorast doesn't sell there maps to Halomaps.org they do it for free but they still might not like people ruining their work but I like moding . I just don't want to be sued or anything like that.

On what terms would they sue you on? How come all the other modders weren't sued?

Modding Halo maps, the original ones, is a direct violation to the licensing agreement you all said yes to when you installed the game. Just because Microsoft does do not sue people for modding does not mean that they give up the right to. For example if you created or modded a map showing explicit XXX porn or visualizations that defamed the brand, once they knew about it, I am sure that MS would start the process.

Just because there is little likelihood that MS will sue you for modding a map, does not mean that they can't or won't.

What would they sue us for? Copyright infringement?

Oh just the origional ones? But can we still use them for like private use like in xfire clans and stuff? Because if that is the case I never posted a moded origional Halo ce map that came with the game.
