On what terms would they sue you on? How come all the other modders weren't sued?
Modding Halo maps, the original ones, is a direct violation to the licensing agreement you all said yes to when you installed the game. Just because Microsoft does do not sue people for modding does not mean that they give up the right to. For example if you created or modded a map showing explicit XXX porn or visualizations that defamed the brand, once they knew about it, I am sure that MS would start the process.

Just because there is little likelihood that MS will sue you for modding a map, does not mean that they can't or won't.

Oh just the origional ones? But can we still use them for like private use like in xfire clans and stuff? Because if that is the case I never posted a moded origional Halo ce map that came with the game.

You won't be sued. There are no copyrights on maps.
In essence Microsoft/Bungie hold the copyrights to all things Halo regardless of who actually created them. The maps included.

What would they sue us for? Copyright infringement?
Most likely Money.

I know these are not easy concepts to wrap your heads around because until now you have led a right or wrong, yes or not, you can do that or you can't do that existence. Copyright and Intellectual property laws are mired in all sorts of grey areas of conflicting interpretations one of which is that just because a copyright holder doesn't sue someone doesn't mean he can't or won't.

If you make or mod a fan creation, meaning something for or from the Halo game, and do not try to sell or profit from it or make the Halo franchise look bad or cost them business then you will be ok. As I said Microsoft/Bungie will most likely not bother you, however they have the right to if they wish.

Case in point: HaloGen was ignored until the deal to develop Halo Wars was signed. Halogen was a fan creation that would have been a direct competition to the Halo Wars game and cost MS money. MS issued a cease and desist order or face being sued which was their right to do.

I see... So if the popularity of Halo Custom Edition grew to the point to where it rivaled Halo 3, Microsoft has the right to shut down future production of custom Halo maps?

First that is an unlikely scenario and second you are already licensed to use the Halo CE game. A better one would be if someone modified the game in such as way as to compete with a future project or if someone made a map that had nude AI in sexual congress shouting profanity and making fun of Microsoft and Bungie They could shut it down. For the most part MS is not going to bother you BUT they can.

I think that Halo Ce is better than all 3 games on the console because you can do more. Guys I am making a new topic that is related to our recent talk it is called map editing legeality talk http://forum.halomaps.org/index.cfm%3Fpage=topic&topicID=24708
