Bungie wanted it released, but MS said no, since they used the HPC/CE source code for Anniversary.

O.K. First of all, Bungie nor Microsoft has the source code anymore. Gearbox was the last people to have it. Sadly I've tried what is being done here way back in 2007 and later. No matter how you try all they say is the source code is lost. I've tried. I even made petitions, videos, posters, etc...
You will never get the code, all you will hear is "It's lost and we do not know where it is."

Microsoft obviously has the source code. 343 used it to build the foundations for Anniversary. ;) Besides, the only reason nobody from the community has the source code already is that it's illegal to decompile the game and take the source code without permission/licensing. It's possible to get the source code anyway. Bungie's and Microsoft's devs already know their way around the engine so they could do so more easily than anyone.
