How do I resize a biped, I want to scale up a grunt quite a bit for a mod im making.

Import the .gbxmodel into 3DS Max/Gmax and use the resize tool. You might want to use a cyborg biped for scale.

alright, I imported the grunt in 3ds max and resized him, then exported jms and compiled it back to a gbxmodel. Now when I try to place him in Sapien it doesnt show up and I get error: 04.02.10 12:54:31 OUT OF OBJECTS: cannot create grunt
Is it because I made him too big?

No, its because you need to do the same with the animations and collision, just use dev commands like what Gamma said
